The criminal justice system has changed tremendously over the decades and so has society. It is important that the court system make changes to keep up with the times. There are parts of the court system that need to be identified to have these changes occur. One of these areas is the way courts are managed including their problems and resolutions. A new trend that has emerged is victims’ rights. Victims can now intervene in the cases before sentencing. In the future, courts could lose cases to arbitration and mediation also known as the private sector of the courts. Understanding these changes and issues are important so that the courts can correspond with the trends as they occur. The courts are an important piece of the justice system. In order to meet the domains of the criminal justice system the courts evolve with the new processes and trends as they happen. Below the paragraphs will analyze and explore future management issues dealing with technological innovations and how the new technology is impacting the courts. Along with how victims’ rights are impacting the courts. One of the main issues that the courts are facing in the future is the possible division between the private law sector and the courts. The technological innovations also impacts the courts staff and judges. Current and future trends facing the courts and administrators One of the issues facing the court system today is judges are not able to see many cases because of their administrative role. Judges spend the majority of their time â€Å"papering budgets, scheduling cases, supervising employees, and maintaining court records† (Robinson, 2009, pg. 208, para 5). The courthouse employee’s work together getting cases dispensed as quickly as possible. Some of these cases are dismissed before even being seen because of how many cases there are. Many of the minor cases are plea bargained so that the more serious cases can be seen. In doing this the judges and the courts have more time to spend on the very serious cases such as murder cases. The court system has to make adjustments due to the many cases that they have coming through the courts and they would never caught up because of the fact that there are many people having run in with the law enforcement. Another problem that courts are facing today is the imbalance of power. In the courtroom today the prosecutors have more power because there are the ones that decide if there is going to be charges filed against someone. This means that if the prosecutor does not prosecute a case the judge and defense attorney will have no say in the outcome of that case. One former United States Attorney General has stated â€Å"the prosecutor has more control over life, liberty, and reputation than any other person in America† (Robinson, 2009, pg. 209, para 4). The power that the judges have has been reduced because of the changes in sentencing and rules. The mandatory sentencing laws has given prosecutors the increase power of prosecution control over cases and how they are disposed of. With the power that prosecutors have the justice system is being threatened. If the law was still equal the defense attorney would have the resources they need to help the defendant. The defense attorneys have heavy caseloads because they work for the government and their resources are limited that they can access. Issues and trends regarding language interpretation services Throughout the United States individuals rely on the court system to solve issues and controversies in their lives. Language barriers between an individual and the courts cause the process to get delayed because it causes communication and understanding problems. When a witness is on the stand testifying that speaks a different language that interpreters need to understand what the witness is saying so they can communicate their true meaning of their statement. The United States accepts many different immigrants and the way of communicating. One of the fundamental rights that the United States has is to recognize the important reason why immigrants come to the United States, â€Å"in our country’s belief in equal justice for all, but to have equal justice, every victim, every witness must understand what is happening in the courtroom† (Board of Directors, 2007, pg. 3, para 2). With the increasing population of immigrants that do not speak English is making it harder to accommodate for people because the courts have to make sure that the interpreter fully understands the language and can translate what the witness is saying. New York courts employ approximately 300 full and part time court interpreters, and 1,200 interpreters on the per diem bases, to provide services in over 100 languages† (Board of Directors, 2007, pg. 4, para 2). The multi-faceted type of communication makes it harder for interpreters in the courtrooms because of the words meaning different things in the different cultures in the Un ited States. An interpreter of the courts also needs to understand legal terminology and procedures of the cultural content that impacts all individuals involved in the case. Interpreters will succeed in their jobs if they can convey what the speaker is meaning to say without altering the expression or tone of the speaker. There are three types of interpreting, which are; consecutive, simultaneous, and sight. Consecutive interpreting is when the interpreter waits for a group of words to be spoken before they interpret what was said. Simultaneous is when the interpreter listens and interprets in a different language at the same time. The last is sight and this is when interpreters read one language and translates it aloud in another. Language interpretation services is a permanent component in the criminal justice system so that the constitutional rights requirements are meet for all individuals. Courts are now required to appoint an interpreter when defendants and witnesses do not speak English in a case. Impact that victim rights laws have on court proceedings (past, present, future) Thirty years ago, victims’ rights did not exist. The victims were not notified about the courts processing or if the case was dropped and the defendant was released. Today, every state has an extensive body of basic rights and protections for victims within its statutory code† (Office for Victims of Crime, 2013). Activists discussed amending the Constitution of the United States to recognize victims’ rights statutes in the criminal justice proceedings. It was not until 1982 that a President’s Task Force on victims of crime suggested for the Sixth Amendment of the Constitution to be amended so that victims are included in the judicial proceedings. California was the first state to adopt the constitutional amendment in 1982 and by the end of the 21 century 49 states passed the victims’ Bill of Rights and this gave victims benefits and options in their case. Two presidents supported the amendment of the constitution at the end of the 21st century. The amendment gave victims the right to receive information, protection, and restitution from the offender. This also gave the victim the right to express their views on sentencing, bail, and parole. Victims’ rights has come a long way sense the early 1970’s and will continue to change as it needs too. There are several issues facing the courts and courts administrators system today. The analysis above discussed these issues and give information to support the findings. The information of future management issues and trends regarding language interpretation was discussed in the analysis. The past, present, and future impact of victims’ rights laws on the court proceeding were discussed in detail.

Federal Government on Public School Curriculum Essay

Education is the one which build the molders of the society. It has been one of the major issues tackled during election campaigns and debates. Of all the issues in governance and in leading the nation, federal role in education receives less attention. The federal programs that exist in our country are lacking the ability to meet the standards that would qualify for a world quality yet government-funded education. In the educational system history, less help come from the federal government that worsens the scenario of schools specially those that are considered public. Aside from the role of the federal government in funding education particularly public schools, it is also important for the federal government to make sure that the curriculum be in its world quality standards of learning. The curriculum guides an educational system to be in its right path to reach the proper knowledge and learning. This prohibition is followed by the Controlled Substance Act that prohibits all professional competence in drug control. Another prohibition is the non-sponsorship of the federal government of any kind of testing that is provided for and enacted by law. Consequently, these prohibitions make the responsibility left behind with the States. Each States should have their own means of providing education to their respective youths. The congress had legislated an unconstitutional attitude that pertains to such education that prohibits good governance. This also limits the freedom of speech and freedom of the press. The exclusion of the federal government is not applicable at this time and thus, many (including those in the congress) suggest giving the proper education aid as soon as it should be. As an improvement, Former President George W. Bush passed â€Å"The No Child Left behind Act of 2001† which intends to increase the federal government’s support and involvement to education was legalized. The Federal government together with the US Department of Education should allow the idea of a national curriculum for public schools. In this way, the State and local educational offices will only maintain and enforce the standards without even evaluating the curriculum. Leadership is an abstract idea that accommodates many descriptions which all seek to harmonize the meaning and definitions that are associated with someone being a leader. In the social sphere, it can be regarded as the way in which some certain individual with desired characteristics like social responsibility take up the helms or control in social domains.This control is aimed at filling a vacuum that exists for the coordination of activities and the making of some crucial decisions for the well being of all. All this is aimed at accomplishment of certain personal or national goals.Mahatma Gandhi is someone who can be regarded as a leader by what he did for his country and the great feats that he achieved during his lifetime. He was born in India (1869- 1948) from not such an influential background but due to his dedication and devotion to his idealism in life, he arose through the ranks to become a national leader that was revered by all people.His political ambition was rekindled after he moved to Africa (South Africa) as an attorney and he saw the rampant abuse of human rights by the Transvaal’s discriminatory government which took him into the limelight as being a tenacious crusader of human rights.His fights and campaigns did not end there in South Africa but the ambition was developed onto a calling which later was culminated into his character. This was an instrumental step that led to development of his system of non violent defiance so as to achieve a common good for all. Selflessness is one of the traits that are exhibited by Gandhi. He never took life as complicated but he denied himself luxuries and the good tidings that come with being a nationalistic leader. He led a simple ascetic life that served to make him more appealing to all people both poor and rich or mighty (Fischer 67).Leadership comes with an arduous task of dealing with all kinds of people from different walks of life. This calls for a sober mind and an all inclusive approach to life. All this is controlled by humility which is a requirement of a leader and not a necessity. Humility can guarantee you ac cess and audience with all regardless of their social class.By being a humble person means that you will go out of your way to serve others and not wait to be served. Often most people associate leadership with being a boss over other people but it should be the other way round. In serving others, your leadership skills are enhanced and you get a one on one experience such that many people will regard you high as opposed to serving others and you one person, you will regard others high.This is one trait that made Mahatma Gandhi to stand out from the crowds. He was always out there serving others and more so the poor and those who are regarded as low in the Indian caste system. He even left his own caste and went down to lower caste (that was for predominantly poor) and tried to raise its social status and put it at par with other social castes. This made him a champion of fighting for rights of the poor and the minority.Approach to leadership should be broad minded and not narrow. In his lifetime, Gandhi was always striving for peace, harmony and good co existence regardless of ones religious inclinations or beliefs (Fischer 56).It is said that he studied all the major religions of the world (Christianity, Islam and Hinduism) in his quest for searching for truth which would promote national cohesion.When I was in high school, I was very much involved in sports and extra curricula activities. Actually, when I joined college it was on sch olarship emanating from my athletic abilities. I indulged mostly in basketball where I played in the position of a forward. In a basketball game (in all sport for that matter) the ultimate goal is to win trophies and be the best in the sport.For a team to achieve this, all personal ambitions have to be shed for the benefit of the team. All the team members are gifted with different skills and individual talent in most cases can not win games but it is the combined efforts of the team members that win games and trophies.By the mere fact that you made the shortlist, was an indication enough that you were talented and capable of success. I was a forward and was selected as the team captain not that I was the best in the team but I had some characters that fitted a leader.It is often said that it is the people who designate you a leader and not you that designate yourself, therefore the coach had confidence that I could deliver as a captain and help my team win trophies. The best chance that arose for me to exhibit my leadership prowess was during one time in the conference finals where it was do or die to clinch the title.The game started well and proceeded on till the last dying moments when there were five minutes on the buzzer and we were trailing our opponents by five points. In basketball any body can score but that job is better left to the forwards because of their enhanced speed and accuracy.I was good at shooting but there was this guy who was a guard but he was not a regular in the first team. His advantage was that he was very good when it came to three pointers. Someone had to be axed so that this guy could be given a chance to even the scores and win the game for us.In the last time off, I convinced the coach to give that guy my chance so that he could use his prowess in shooting three pointers. Along the way, Che is exposed to extreme events of poverty, vulnerability, and overall suffering. Originally, Che’s only goal in life was to become a famous doctor who would help fight off the leper disease invading South America. During the course of the journey, however, Che transforms from an innocent, simple-minded young man to a knowledgeable traveler, and finally to a powerful revolutionary that has his sights set much, much higher. Here are the events that helped to trigger this transformation in Ernesto Che Guevera. At the beginning of the journey, the only thing Che can focus on is the thought of becoming a doctor. â€Å"In the shade of the immense trees, we made plans to build a laboratory in this place, when we finished with our trip. Keep in mind, that at this point in the journey, he wasn’t even close to crossing the border of Argentina, let alone his final destination. This is the simple-mindedness of young Che Guevera coming out. He is constantly thinking about the final result, and by doing so, he isn’t able to fully appreciate what is going on around him. At this time, Che is only thinking of himself. But as he continues on his way, a few distinct events help begin to transform Che into the revolutionary that he is today. As Che progresses further to his destination, he begins to title himself as a leprosy doctor. As he stop sin towns along the way, he begins to provide medical assistance to those in need. At this time, it was mostly to practice for when he was to become famous later in life. But one town he stopped in began to change his whole perspective on what â€Å"helping people† was. â€Å"Soon the whole family was gathered around the article. And so, like this, basking in their admiration, we said goodbye to those people we remember nothing about, not even their names. †-pg. 59. He is basically saying that once he did what he needed to do, that was that. There were of people suffering in South America at the time. And he had helped only a few people. This event started to make Che think on a bigger scale, and gave him a little push in the direction of really making a difference in the lives of ALL those suffering people. As he reaches the end of his journey, Che has reached the final step of his transformation. Che has finally arrived at the leper colony, the much-anticipated end to his amazing journey. But Che has experienced things along the way that have changed his way of thinking. He doesn’t want the journey to end right here. He has figured out the way to truly make a difference in the lives of the South American people. Here is a quote that demonstrates what he has learned and how much he has transformed. â€Å"We must begin to erase our old concepts and come ever closer and ever more critically to the people. Not in the way we got closer before. Everybody has done that. But they have done it practicing charity, and what we have to practice today is solidarity. We should not draw closer to the people and say: Here we are. We come to give you the charity of our presence, to teach you with our science, to demonstrate your errors, your lack of refinement and knowledge. We need to go humbly to learn from the great source of wisdom that is the people. †-pg. 173 Che Guevera has gone from a narrow-minded individual to someone who is capable of caring for an entire population. He has grown into someone who can see through they eyes of the people who are suffering. He can see where things need to be improved. Che Guevera became the person he wanted to be at the beginning of the journey-a difference maker. But he has done so in a much different and more effective way. Female slaves had to endure the hardships of motherhood in very harsh conditions. Motherhood set a different experience of women slaves from their male counterparts. Female slaves were subjected to a hard situation whereby they are forced to prioritize their activities Jacobs had to prioritize between being a slave and being a mother concerned about the welfare of her children. After Jacobs had learnt that Dr. Flint wanted to make her and her children slaves, she took the risk of escaping to save the destiny of her children, despite knowing the consequences that would happen to her if she was caught.
